REACH

 The Amendments to Information Requirements under REACH will Apply from 14 Oct. 2022

The European Commission has revised certain information requirements for registering chemicals under REACH. Companies should start to prepare as the changes will begin to apply in October 2022.
Note: Under the current Annex VI of REACH Regulation, if related enterprises entrust an OR (Only Representative) to complete REACH registration on their behalf, information of the OR is required only. However, the amendments require basic information of the non-EU enterprises who appointed the OR as well, including name, address, telephone number, email address, contact person, location of the production site, enterprise website, etc.
Requirements and specific rules for adaptation of: 
- in vitro and in vivo mutagenicity studies, specifying when further studies are needed based on mutagenicity concerns; 
- reproductive toxicity studies, specifying the preferred animal species and administration routes, ...; 
- aquatic toxicity studies, clarifying when long-term studies must be performed instead of short-term studies or in addition to them; 
- toxicity studies on terrestrial and sediment organisms, specifying when long-term studies are needed instead of short-term .....

Candidate List updated with two chemicals that are toxic for reproduction Source ECHA (19 January 2021)
The Candidate List of substances of very high concern now contains 211 chemicals that may harm people or the environment.
The added two substances are used in products, such as inks or toners and to produce plastics and rubber tyres. They are toxic for reproduction and therefore, may adversely affect sexual function and fertility, and cause developmental toxicity in offspring.
- Bis(2-(2-methoxyethoxy)ethyl)ether: Examples of use(Solvent/extraction agent)
- Dioctyltin dilaurate:Examples of use (additive in the production of plastics and rubber tyres)

Updated IT tools and Brexit advice for companies

ECHA has adapted its IT tools and advice to companies to take into account the Protocol on Ireland and Northern Ireland and the end of the transition period of the UK’s withdrawal from the EU. Companies should act now if they are affected by the withdrawal.
The transition period of the UK’s withdrawal from the EU ends on 31 December 2020, and the Protocol on Ireland and Northern Ireland starts to apply from 1 January 2021.
REACH, CLP, the BPR, PIC and POPs will continue to apply in Northern Ireland (UK(NI)) after the transition period, but will no longer apply in the rest of the UK (UK(GB)).

Deadlines for updating registration dossiers clarified

The European Commission has clarified when companies need to update their REACH registration dossiers. The requirement to update ‘without undue delay’ is in most cases specified as three months and, in more complex cases, up to 12 months.

REACH : ECHA’s committees conclude on five restrictions

The Committee for Socio-economic Analysis (SEAC) adopted its opinion on the restriction proposal for siloxanes (D4, D5, D6) in personal care products while the Committee for Risk Assessment (RAC) adopted its opinion, among others, on skin sensitising substances used in textile and leather products.

REACH
REACH is a regulation of the European Union, adopted to improve the protection of human health and the environment from the risks that can be posed by chemicals, while enhancing the competitiveness of the EU chemicals industry. It also promotes alternative methods for the hazard assessment of substances in order to reduce the number of tests on animals. 

In principle, REACH applies to all chemical substances; not only those used in industrial processes but also in our day-to-day lives, for example in cleaning products, paints as well as in articles such as clothes, furniture and electrical appliances. Therefore, the regulation has an impact on most companies across the EU.The Candidate List of substances of very high concern (SVHCs) for authorisation now contains 205 substances.

Four new substances added to Candidate List

The Candidate List of substances of very high concern (SVHCs) for authorisation now contains 205 substances.
ECHA has added three new substances to the Candidate List due to their toxicity to reproduction and a fourth due to a combination of other properties of concern. This latter causes probable serious effects to human health and the environment, giving rise to an equivalent level of concern to carcinogenic, mutagenic and reprotoxic (CMR), persistent, bioaccumulative and toxic (PBT) and very persistent and very bioaccumulative (vPvB) substances.

New substances included in the Candidate List for authorisation are:
  • Diisohexyl phthalate:                                                                             Not registered under REACH
  • 2-benzyl-2-dimethylamino-4'-morpholinobutyrophenon:          The substance isused in polymer production
  • 2-methyl-1-(4-methylthiophenyl)-2-morpholinopropan-1-one: The substance is used in polymer production
  • Perfluorobutane sulfonic acid (PFBS) and its salts:                    Used as a catalyst/additive/reactant in polymer/additive/                                                                                                                               reactant in polymer manufacture and in chemical synthesis.                                                                                                                         It is used as as a flame retardant too.

The Candidate List of substances of very high concern (SVHCs) for authorisation now contains 201 substances.
    > 2-methoxyethyl acetate: Use (Not registred under REACH)
    > Tris(4-nonylphenyl): Use (Primarily used as an antioxidant to stabilise polymers)
    > 2,3,3,3-tetrafluoro-2-(heptafluoropropoxy)propionic acid, its salts: Use (Processing aid in the production of fluorinated polymers)
    > 4-tert-butylphenol: Use (as a flavoring agent or a component of coating products, polymers, adhesives, sealants and for the 
      synthesis of other substances)

  ECHA start work on Persistent Organic Pollutants:

  ECHA starts working on scientific, technical and administrative tasks to identify and regulate persistent organic pollutants   
  (POPs).
  Key points:
  • The POPs Regulation bans or severely restricts the production and use of persistent organic pollutants in the European Union.
  • The Agency will support the identification of new POPs substances.
  • This includes compiling and publishing information from the Member States on uses, volumes, releases, monitoring data, stockpiles and waste related to POPs
  • Promoting an exchange of information on POPs between various EU actors and third countries.
  • In 2020, ECHA will integrate data on POPs to its chemicals database.
